DWI (Impaired Driver) & Court Evaluations

Have you been Court Ordered to obtain a Substance Abuse Evaluation?

Have you been arrested for or convicted of any of the following in NYS?

DWAI (Driving While Ability Impaired) 

  • DWI (driving while intoxicated/impaired)

  • Aggravated DWI

  • DUI (driving under the influence)

  • Other Impaired Driving Offense

If so, together, we can navigate the complicated legal, emotional and practical issues facing you as a result of the charge. The New York State Office of Alcoholism and Substance Abuse Services (OASAS) requires that you undergo a Clinical Screening and Assessment by an OASAS approved provider. Ms. Myers is a NYS OASAS Approved Provider for Clinical Screening and Assessment for Impaired Driver Offenders and a licensed clinical social worker (NY) experienced in clinical assessment and evaluation.

What to expect with a Clinical Screening and Assessment?

There are several required components of the Clinical Screening and Assessment:

  1. Signed NYS OASAS IDS (Impaired Driver Services) consent form

  2. A Urine Drug Screen (UDS)

  3. Several completed questionnaires and measures

  4. Copies of the arrest report(s)

  5. Information obtained from at least one collateral person (someone who knows you well)

  6. A face to face meeting

The Clinical Screening and Assessment can typically be completed in one session, IF you provided all the necessary documentation at least 3 business days before our appointment.

After scheduling the Clinical Screening and Assessment appointment, you will need to:

  1. Obtain the packet of questionnaires and measures

  2. Complete the UDS

In order to complete the evaluation assessment and report, Ms. Myers need’s the following:

  1. Completed questionnaires and measures

  2. Documentation regarding the alleged incident(s) and arrest(s) such as arrest report(s)

  3. Completed collateral information 

  4. Results of the UDS

  5. Any other supporting documents


Impaired Driver Clinical Screening and Assessment Fees

A non-refundable deposit of $50.00 is required for all Impaired Driver Clinical Screening and Assessment appointments at the time of scheduling to confirm and hold your appointment. The deposit will be applied to your balance due at the end of your Screening and Assessment appointment. The remaining balance is due at the time of the appointment and is payable by cash, check, or credit card.

Expedited Psychological Evaluation and Report. If your court hearing is imminent (e.g., within a week or two of contacting me) and you are able to complete the UDS, I can usually offer an expedited evaluation and report for an additional fee. That is, we can schedule the psychological evaluation between two to four business days of the hearing. Your lawyer will receive the report within two business days after our evaluation meeting, assuming that all of the materials were received at least 24 hours before our appointment.

The additional fee for an Expedited Psychological Evaluation and Report is $100.

Please note, the assessment interview is not covered by health insurance as many insurance companies do not see this as medically necessary. If requested, Ms. Myers will be happy to provide you with a receipt so that you can submit it for reimbursement directly to your insurance provider. In addition, the Urine Drug Screen is an expense paid by you or through your insurance carrier directly to the laboratory.


Late or Missed Appointments: If you are late for or miss the appointment without providing 24-hour notice, a second session will be required which will delay receiving your assessments/paperwork required for the courts and/or DMV. In addition, you will be required to pay in full at the time of scheduling your second appointment.

The Screening and Assessment interview is an evaluation of a combination of the circumstances leading up to your arrest, your history and pattern of alcohol and substance use, and your overall psychological and social functioning. 

Ms. Myers approaches the Clinical Screening and Assessment interview as an opportunity for you to step back and evaluate the role of alcohol and substances in your life, and the consequences thereof.  Safety, trust, and honesty are essential to the screening and assessment process – our goal is provide you a non-judgmental supportive environment where you feel safe enough to talk openly about the events leading up to the arrest, substance use, and your general functioning.

If you are uncomfortable with the results of the assessment, you are entitled to receive a second opinion and are free to withdraw the release of information form.

​Residents of New York State charged with or convicted of an impaired driving offense ( DWI, DWI, DWAI/Drug, DWAI/combination) may be required or recommended to have a clinical screening and assessment of alcohol or substance use at the time of arraignment or prior to sentencing when the individual is charged with or convicted of operating a motor vehicle while under the influence of alcohol or drugs:  

New York State Office of Alcohol and Substance Abuse Services (OASAS) requires authorization to provide clinical screening, assessment, and treatment services for impaired driving offenders. 

  • Driving while intoxicated (DWI) .08 blood alcohol content (BAC) or higher or other evidence of intoxication

  • For drivers of commercial motor vehicles:  .04 BAC or other evidence of intoxication

  • Aggravated driving while intoxicated (aggravated DWI) .18 BAC or higher

  • Driving while ability impaired by alcohol (DWAI/Alcohol)  more than .05 BAC but less than .07 BAC

  • Driving while ability impaired by a single drug other than alcohol (DWAI/Drug)

  • Driving while ability impaired by a combined influence of drugs or alcohol (DWAI/Combination)

  • Chemical test refusal - a driver who refuses to take a chemical test (normally a test of breath, blood or urine)

  • Zero tolerance Law

  • A driver who is less than 21 years of age and who drives with a .02 BAC to .07 BAC violates the Zero tolerance law

The clinical screening and assessment  adhere to NYS OASAS General Service Standards for Clinical Services Provided to Individuals Arrested for an Impaired Driving Offense.
